1. Overview
By engaging with our counselling and coaching services, you agree to the following terms and conditions. This agreement governs the services provided by Ben Pangas and applies to all clients using individual counselling, group coaching, Enneagram assessments, executive coaching, workshops, and professional supervision services. This agreement is legally binding in accordance with Australian law, including the relevant Tasmanian statutes.
2. Services Provided
We offer the following services:
- Individual counselling
- Group coaching
- Workshops
- Enneagram assessments
- Executive coaching
- Professional supervision
Clients under the age of 16 must have written consent from a parent or legal guardian to participate in services.
3. Confidentiality and Privacy
All sessions are confidential, except where disclosure is required by law (e.g., risk of harm to self or others, mandatory reporting of child abuse). We adhere to the PACFA Code of Ethics and the ICF Code of Conduct, which govern confidentiality and professional conduct. You can review these codes at the following links:

We comply with the Privacy Act 1988, and your personal information will be handled in accordance with the Australian Privacy Principles. A copy of our Privacy Policy Can be found HERE
4. Payment Terms
- All payments are due within 14 days of invoicing.
- Secure online payments can be made via Stripe.
- Invoicing occurs after each session.
- If previous payments are outstanding, services may be withheld until all payments are cleared.
5. Cancellation and Rescheduling
- To reschedule a session, you must notify us via email or instant messaging at least 24 hours in advance.
- If a session is cancelled less than 24 hours before the scheduled time, the session fee will not be refunded or replaced, except in exceptional circumstances at the Coach's discretion.
- Exceptional circumstances (e.g., medical or family emergencies) will be evaluated on a case-by-case basis.
- Either party may terminate this agreement by giving 7 days’ notice in writing (by email or letter). Outstanding payments must be settled upon termination.
6. Limitations of Services
- Our services are not a substitute for medical or psychiatric advice.
- In the event that you experience any mental, emotional, or physical distress as a result of our services, you agree to hold the organisation harmless and indemnify us from any related claims or losses.
- This agreement constitutes the entire understanding between you and the organisation regarding the services provided.
7. Dispute Resolution
In the event of a dispute or complaint, we encourage open communication to resolve any issues. Should further resolution be required:
- Mediation: If the dispute cannot be resolved through discussion, both parties agree to attempt mediation before initiating legal proceedings.
- Arbitration: If mediation is unsuccessful, the parties agree to submit the matter to arbitration.
8. Liability and Indemnity
We hold current public liability and professional indemnity insurance. However, we do not accept responsibility for:
- Any direct or indirect personal injury, loss, or damage resulting from your participation in our services.
- Any outcomes resulting from the advice or recommendations provided during coaching or counselling sessions, as results are dependent on individual implementation.
9. Jurisdiction
These terms are governed by the laws of Australia and, where applicable, the laws of Tasmania. All legal matters will be dealt with in the jurisdiction of Tasmania unless otherwise agreed by both parties.
